1. Introduction
These Terms and Conditions govern your use of Bersiv, a mobile application available on the Apple App Store. By downloading or using Bersiv, you agree to these Terms. If you do not agree, please do not use the app.
Bersiv is a Kurdish language learning application that teaches native Kurmanci vocabulary by replacing Arabic loanwords with their authentic Kurdish equivalents.
2. Eligibility and Age Requirements
Bersiv is available to users aged 4 and older. By using the app, you confirm that you meet this age requirement. If you are under the age of majority in your jurisdiction, you confirm that you have your parent or guardian's permission to use the app and make purchases.
3. Account Registration
Creating an account is optional and not required to use the basic features of Bersiv. You may use the free features of the app without registering.
If you choose to create an account, you agree to:
- Provide accurate and truthful information
- Keep your login credentials secure and confidential
- Notify us immediately of any unauthorised use of your account
- Take responsibility for all activity that occurs under your account
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Free and Premium Features
Bersiv operates on a freemium model:
- Free users have access to selected vocabulary categories (currently "Mind & Mood" and "Life & Actions") without any charge.
- Premium users gain access to all vocabulary categories and features by purchasing a subscription or lifetime plan through the Apple App Store.
We reserve the right to change which features are available for free at any time, with reasonable notice provided where possible.
5. Subscriptions, Purchases and Payments
5.1 Free Trial
New users automatically receive a 3-day free trial with access to all premium features. No payment is required to start the trial. After the trial period expires, access reverts to the free tier unless you purchase a subscription or lifetime plan.
You can also earn additional free days by inviting friends to Bersiv. Each successful referral adds 7 extra days to your access, up to a maximum of 21 bonus days total.
5.2 Available Plans
Bersiv offers the following purchase options through Apple In-App Purchases:
- Monthly subscription — billed monthly, renews automatically
- Annual subscription — billed once per year, renews automatically
- Lifetime plan — a one-time payment that provides permanent access
5.3 Billing and Renewal
Subscription prices are displayed in the app at the time of purchase. Your subscription will automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Payment is charged to your Apple ID account upon confirmation of purchase.
5.4 Managing and Cancelling Subscriptions
You can manage or cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period — you will retain access to premium features until that date. Cancellation does not entitle you to a refund for the current billing period.
5.5 Lifetime Plan
The lifetime plan grants you ongoing access to all premium features for a single one-time payment. This access continues for as long as Bersiv is operational. In the event that Bersiv is discontinued, we will provide reasonable notice to lifetime plan holders.
5.6 Price Changes
We reserve the right to change subscription prices. You will be notified of any price changes before they take effect, and you will have the opportunity to cancel before the new price applies.
5.7 Refunds
All purchases are processed by Apple. Refund requests must be submitted to Apple in accordance with Apple's refund policy. We do not handle refunds directly. Please visit Apple's support to request a refund.
6. Right of Withdrawal (EU and EEA Consumers)
If you are a consumer located in the European Union or the European Economic Area, you have the right to withdraw from a purchase within 14 days without giving any reason (the "cooling-off period").
However, by starting to use digital content or a service immediately after purchase, you expressly consent to the immediate performance of the contract and acknowledge that you lose your right of withdrawal once the service has been fully performed or the digital content has been made available to you.

7. Right to Cancel (UK Consumers)
If you are a consumer in the United Kingdom, you have the right to cancel your purchase within 14 days. This right does not apply once you have begun accessing digital content or services delivered immediately upon purchase. To request cancellation, contact us at .
8. Right of Regret (Brazilian Consumers)
If you are a consumer located in Brazil, you have the right to withdraw from a purchase made outside of a physical establishment within 7 days of the date of purchase or receipt of the service, in accordance with the Brazilian Consumer Protection Code (CDC). 9. Content and Intellectual Property
All content within Bersiv — including Kurdish vocabulary data, example sentences, illustrations, the goat mascot, the mountain and sunburst visual identity, app design, audio content, and all text — is owned by or licensed to Bankin Alo. All rights are reserved.
You may not copy, reproduce, distribute, modify, or commercially exploit any part of Bersiv's content without our prior written permission. The name "Bersiv" and associated branding are the intellectual property of Bankin Alo.
10. Acceptable Use
By using Bersiv, you agree not to:
- Use the app for any unlawful purpose or in violation of applicable laws
- Attempt to reverse-engineer, decompile, or extract the source code
- Transmit any harmful, offensive, or disruptive content
- Attempt to gain unauthorised access to any part of the app or its infrastructure
- Use automated tools to scrape or extract content from the app
11. Apple App Store Terms
Bersiv is distributed exclusively through the Apple App Store. Your use of Bersiv is also subject to Apple's Terms of Service. Apple is not a party to these Terms and is not responsible for Bersiv or its content.
12. TestFlight Beta Testing
From time to time, Bersiv may be distributed via Apple's TestFlight platform for testing purposes. TestFlight builds are pre-release versions and may contain bugs or incomplete features.
13. Disclaimers
Bersiv is provided "as is" without warranties of any kind. While we take care to ensure the accuracy of Kurdish vocabulary content — cross-referencing against multiple dictionaries — we cannot guarantee that all linguistic content is free from error. We welcome corrections from native speakers at .
14. Limitation of Liability
To the maximum extent permitted by applicable law, Bankin Alo shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of Bersiv. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
15. Dispute Resolution
If you have a complaint, please contact us at and we will aim to resolve it within 7 days. EU consumers may also use the European Commission's Online Dispute Resolution platform.
16. Governing Law
These Terms are governed by the laws of Austria. Any disputes shall be subject to the exclusive jurisdiction of the courts of Austria, except where mandatory consumer protection laws in your country of residence provide otherwise.
17. Account Deletion and Data Removal
You have the right to request the deletion of your account and all associated personal data at any time. To request account deletion, please contact us at with the subject line "Delete My Account".
We will process your request and permanently delete your data within 30 days. Please note that deleting your account will permanently remove your progress, streak history, mastered words, and all other data. This action cannot be undone.
If you have an active subscription, please cancel it through the App Store before or after requesting account deletion, as account deletion does not automatically cancel your subscription.
18. Changes to These Terms
We may update these Terms from time to time. When we make significant changes, we will notify you through the app. Your continued use of Bersiv after changes take effect constitutes acceptance of the updated Terms.
